Foley & Lardner LLP Partner John Zabriskie and Associates Ryan Lowry and Zachary Kumar recently authored an article for Law360 titled, “Parsing The Recent Surge In Midwest Food Labeling Litigation.” The article examines the uptick in food labeling cases filed in Midwest states – Illinois, Indiana, Iowa, Michigan, Missouri, Minnesota, Ohio and Wisconsin – in 2021 and discusses noteworthy decisions handed down by federal courts in those states over late 2020, 2021 and early 2022. Given the volume of 2021 cases and the number of motions to dismiss filed in those cases, rulings from Midwest courts will have an increasingly prominent role in food labeling jurisprudence in 2022.
